Race and related grounds

Under the Code, every person has the right to be free from racial discrimination and harassment in the social areas of employment, services, goods, facilities, housing accommodation, contracts and membership in trade and vocational associations. You should not be treated differently because of your race or other related grounds, such as your ancestry, ethnicity, religion or place of origin.

Canada, its provinces and territories have strong human rights laws and systems in place to address discrimination. At the same time, we also have a legacy of racism – particularly towards Indigenous persons, but to other groups as well including African, Chinese, Japanese, South Asian, Jewish and Muslim Canadians – a legacy that profoundly permeates our systems and structures to this day, affecting the lives of not only racialized persons, but also all people in Canada.

Relevant policies:

Recognizing a rise in acts of anti-Black racism in Ontario communities and public schools, in March 2023, the Ontario Human Rights Commission (OHRC) announced an initiative to tackle the crisis of systemic anti-Black racism in Ontario’s publicly-funded education system. The OHRC is committed to the development of a province-wide strategy on accountability for, and impact of, anti-Black racism and discrimination in education related to the roles and functions of the education sector, community, and the OHRC.

Black leadership and community engagement have been at the forefront of action to address systemic discrimination and advance racial equity in Ontario. The Ontario Human Rights Commission (OHRC) recognizes that Black individuals, organizations, and grassroots movements have been working on issues of anti-Black racism in education for decades. The OHRC acknowledges and embraces the work of generations of grassroots and community-led organizing and academics and the significant strides toward protecting the safety and well-being of Black children in Ontario’s publicly funded education system. The OHRC has tried to capture and preserve those works in its initiative to address anti-Black racism in Ontario’s education system. We are grateful for those works and honour the people who have contributed to them.

The Standing Senate Committee on Human Rights (the Committee) invited the Ontario Human Rights Commission (the OHRC) to make a brief submission to the Committee on best practices or policies for combatting anti-Black racism and to share the OHRC’s perspective on a direct tribunal access model compared to a commission screening model for dealing with human rights complaints.

On February 1, 2023, five Royal Canadian Mounted Police (RCMP) officers in British Columbia were charged with manslaughter and obstruction of justice in the 2017 death of Dale Culver, a member of Wet’suwet’en and Gitxsan First Nations, and father of three children who was killed in custody.

Following the release of A Disparate Impact, Drs. Wortley and Laniyonu identified a coding error in which civilian race was incorrectly coded in the multivariate analysis. The Ontario Human Rights Commission (OHRC) retained Dr. Maria Jung to independently review the error.

The OHRC is aware the TDSB has taken a decision to end the School Resource Officer (SRO) Program. It recognizes your obligation as a duty-holder to protect the safety of students. However, to the extent that there are bona fide and legitimate reasons to seek external help, the OHRC reminds all parties that the discussion and decision should be informed by human rights principles as set out in the Ontario Human Rights Code (the Code).
