Race and related grounds

Under the Code, every person has the right to be free from racial discrimination and harassment in the social areas of employment, services, goods, facilities, housing accommodation, contracts and membership in trade and vocational associations. You should not be treated differently because of your race or other related grounds, such as your ancestry, ethnicity, religion or place of origin. 

Canada, its provinces and territories have strong human rights laws and systems in place to address discrimination. At the same time, we also have a legacy of racism – particularly towards Indigenous persons, but to other groups as well including African, Chinese, Japanese, South Asian, Jewish and Muslim Canadians – a legacy that profoundly permeates our systems and structures to this day, affecting the lives of not only racialized persons, but also all people in Canada.

  1. Human Rights Commission to hear personal accounts of racial profiling

    February 17, 2003

    Toronto - Following up on a commitment made in December to take action on racial profiling, Chief Commissioner Keith Norton today announced plans to hold an inquiry into this activity. "Racial profiling in any context is wrong. We are concerned about the negative impacts of this practice on individuals and entire communities," stated Mr. Norton. "To address the issue, the Commission has worked closely with community partners and this initiative is a result of that cooperative effort," he further added. Over the next two weeks, interested individuals who believe that they have been profiled are invited to talk about that experience with the Commission and relate the repercussions that the incident has had on their lives and their outlook towards society.

  2. Letter to Minister Christine Elliott re: COVID-19 Action Plan for Vulnerable People

    June 4, 2020

    The OHRC welcomes the April 23 release of the government’s COVID-19 Action Plan for Vulnerable People (the Plan) as a first step toward addressing the disproportionate impact that the pandemic is having on Ontario’s most vulnerable people. However, to ensure that the human rights of vulnerable people are protected in a way that is consistent with Ontario’s Human Rights Code, the Plan requires expanded scope and detail, which must be done in consultation with vulnerable groups and human rights experts.

  3. Letter to President/CEO of Ontario Health re: COVID-19 triage protocol, data collection, essential support persons

    June 4, 2020

    Over the last two months, the OHRC has met with a range of stakeholders representing racialized communities, people experiencing poverty, people with disabilities, older people and other Code-protected groups. These groups are concerned that certain aspects in the management of the COVID-19 pandemic are having a negative impact on their human rights, and have raised four immediate concerns

    I am writing today to stress the important role that human rights principles should play in any reviews of Ontario government and long-term care service provider responses to the COVID-19 pandemic.

  5. Letter to universities and colleges on racism and other human rights concerns

    December 18, 2020

    I am writing to all public colleges and universities in Ontario after recent events have exposed that Indigenous, Black and racialized students are experiencing significant concerns of discrimination, xenophobia and targeting on campuses and in academic environments across Ontario. As service providers, all academic institutions have legally mandated human rights obligations to their students under the Ontario Human Rights Code (Code).
